Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of DigitalGut, a website and service operated by Digital Biology LLC (“DigitalGut,” “we,” “us,” or “our”). DigitalGut helps you understand a gut-microbiome test you already have: you upload or enter your results, and we translate them into a clear, plain-language read of your microbiome, with every insight cited to peer-reviewed research.
1. Acceptance of these Terms
By creating an account, clicking to accept, or otherwise accessing or using DigitalGut, you agree to be bound by these Terms and by our Privacy Policy and Consumer Health Data Privacy Policy, which are incorporated by reference. If you do not agree, do not use the service. You represent that you have read and understood these Terms, that you are of legal age to form a binding contract, and that you have the authority to enter into these Terms.
2. No medical advice
The information, reports, scores, summaries, action plans, and answers provided by DigitalGut(collectively, the “Content”) are for general informational and educational purposes only. They are not medical advice, do not constitute the practice of medicine, and are not a substitute for professional medical judgment, diagnosis, or treatment.
DigitalGut does not diagnose, treat, cure, or prevent any disease or condition. Microbiome science is emerging, reference ranges vary between labs, and individual results can be interpreted in many ways. Always seek the advice of a qualified healthcare professional before making any change to your diet, supplements, medication, or care, and never disregard professional medical advice or delay seeking it because of something you read on DigitalGut. You are solely responsible for any actions you take based on the Content.
3. Changes to these Terms
We may modify these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of DigitalGut after changes become effective constitutes your acceptance of the revised Terms. We may also change, suspend, or discontinue any part of the service at any time.
4. Eligibility
DigitalGut is intended for adults 18 years of age or older. The service is operated from the United States; we make no representation that the Content is appropriate or available for use in other locations. You are responsible for compliance with all laws applicable to you.
5. Your account
To use most features you must create an account. You may sign in with a one-time emailed magic link or, optionally, a password. You agree to provide accurate information and to keep it current, and you are responsible for all activity that occurs under your account and for maintaining the confidentiality of your sign-in credentials. Notify us promptly at [email protected] if you suspect unauthorized use of your account.
6. Your content and data
“Your Content” means the test results, files, text, and other information you upload or enter. You retain ownership of Your Content. By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and use it for the purpose of operating and providing the service to you — including sending the relevant data to the third-party infrastructure and AI providers described in our Privacy Policy so we can generate your reports and answers.
You represent that you have the right to submit Your Content and that doing so does not violate the rights of any third party. We may create de-identified or aggregated data from Your Content; such data does not identify you and may be used to operate and improve the service.
7. AI-generated content
DigitalGut uses artificial intelligence and large language models, together with a library of peer-reviewed research, to generate interpretations, summaries, and answers. You acknowledge that:
- AI-generated output may be inaccurate, incomplete, or out of date, and may not reflect the most current science;
- you should independently evaluate the Content — and consult a qualified professional — before relying on it; and
- citations and references are provided so you can read the underlying sources yourself; their inclusion is not an endorsement, and we do not guarantee that any cited study applies to your situation.
8. Acceptable use
You agree not to:
- use the service for any unlawful, harmful, or fraudulent purpose;
- upload another person’s data without authorization, or impersonate anyone;
- access the service by automated means (robots, spiders, scrapers) or attempt to circumvent security, rate limits, or access controls;
- reverse engineer, decompile, or attempt to extract the source code, models, or underlying data of the service, except where permitted by law;
- interfere with or disrupt the service, or introduce malware or other harmful code; or
- use the service to build or train a competing product, or for competitive analysis.
9. Subscriptions, purchases, and billing
Some features require payment. We offer paid subscriptions (billed monthly or annually) and one-time report purchases. Prices are shown at the point of purchase. Payments are processed by our third-party payment processor; by purchasing, you authorize us and our processor to charge your selected payment method.
Auto-renewal. Paid subscriptions automatically renew — monthly plans month-to-month and annual plans for successive 12-month terms — at the then-current price, until you cancel. You can cancel at any time from your account settings; cancellation stops future renewals and takes effect at the end of the current billing period. We may change our prices, but a price we have quoted for a current subscription term will remain in effect for that term.
10. Refunds
One-time report purchases are final and non-refundable once the report has been generated or made available to you.
Subscriptions can be cancelled at any time and will not renew thereafter; except where required by law, fees already paid for the current or prior billing periods are non-refundable, and we do not provide partial or prorated refunds for the unused portion of a term. We may, in our sole discretion, issue a refund or credit in individual cases.
11. Intellectual property; license to you
The service and all materials in it (other than Your Content), including software, text, design, and trademarks, are owned by Digital Biology LLC or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to access and use the service for your own personal use. You may not use our name, logo, or trademarks without our prior written permission.
12. Feedback
If you send us suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free license to use it for any purpose without obligation or compensation to you.
13. Termination
You may stop using the service and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or for any other reason. Your only remedy for dissatisfaction with the service is to stop using it and terminate your account. Sections that by their nature should survive termination (including Sections 2, 6, 7, and 11–18) will survive.
14. Disclaimers; no warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT THE CONTENT WILL BE ACCURATE, COMPLETE, RELIABLE, OR CURRENT. YOU ARE SOLELY RESPONSIBLE FOR ANY DECISIONS OR ACTIONS YOU TAKE BASED ON THE SERVICE.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL Digital Biology LLC OR ITS OFFICERS, EMPLOYEES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
16. Indemnification
You agree to indemnify and hold harmless Digital Biology LLC and its affiliates and service providers from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use or misuse of the service, Your Content, or your violation of these Terms or of any law or third-party right.
17. Governing law and dispute resolution
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Before bringing any formal claim, you agree to first try to resolve the dispute informally by contacting us and allowing 30 days to reach a resolution.
Any dispute that is not resolved informally will be settled by binding individual arbitration administered in Sheridan, Wyoming, rather than in court, except that either party may bring an individual claim in small-claims court or seek injunctive relief for intellectual-property or unauthorized-access claims. To the extent permitted by law, you and Digital Biology LLC each waive any right to a jury trial and any right to participate in a class or representative action; disputes will be resolved only on an individual basis. Any claim must be brought within one (1) year after it arises.
18. Miscellaneous
These Terms are the entire agreement between you and Digital Biology LLC regarding the service. If any provision is held unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them freely. We are not liable for delays or failures caused by events beyond our reasonable control.
